Tree Maintenance Rights of the City

If any trees situated in any lot shall, by means of their roots, branches or otherwise become detrimental to the structures, adjacent lot or infrastructure, or become dangerous or inconvenient to passengers or interfere with the scheme of development, or are diagnosed with an epidemic disease, the City shall have the right to enter the said lot and remove the said trees or such parts thereof as are detrimental, dangerous or inconvenient. The Department of Cemeteries will attempt to notify owners when trees on their cemetery lot become potentially hazardous to adjacent property to provide them the opportunity to correct the hazardous situation. If owners have been notified of hazardous conditions but have failed to correct those conditions in the time specified by the notification, any charges for maintenance will be billed against the lot.
